Brian Malley stood before a judge Monday pleading not guilty to first-degree murder charges and two other serious offences.
The advisor is alleged to have delivered a wrapped gift prior to Christmas to the home of client Victoria Shachtay. The gift bag exploded upon opening instantly killing the 23-year-old single mother and orphaning her seven-year-old daughter.
Malley apparently lost all of Shachtay’s money, an estimated $775,000, which he had been entrusted to invest back in 2007 as a result of his client’s court settlement for the crash that put her in a wheelchair.
The advisor, feeling badly about the disappearance of his client’s (and family friend) entire fortune, paid $44,000 to Shachtay in an effort to lessen the blow but apparently ran out of funds.
Malley’s lawyer Bob Aloneissi stated, “If Mr. Malley decided to take pity on Victoria Shachtay, is that a reason to then kill her? Wouldn’t he just stop paying?”
