OSC names RESP players involved in privacy breach

It only took eight months but some of the players behind the Rouge Valley Hospital privacy breach were identified this past week.

The hospital privacy case that’s captivated the interest of advisors across the country, not to mention the ire of Ontario’s Privacy Commissioner, has finally named the RESP players allegedly involved.

The OSC announced Tuesday that a number of charges and quasi-criminal charges have been laid against former Global RESP Corporation sales representative Nellie Acar.

The allegations suggest that Acar bought stolen patient maternity labels from former Rouge Valley Health System nurse Esther Cruz over a two-and-a-half year period as sales leads for potential RESP clients.

Acar is charged with eight alleged breaches of the Criminal Code of Canada while Cruz has been charged with six alleged breaches of the Criminal Code.

Also revealed, Shaida Bandali, who WP’s written about on several occasions, is alleged to have sold confidential maternity information over a five-year period to both a former branch manager of Knowledge First Financial Inc. and a former assistant branch manager with C.S.T. Consultants.

Still early in the game, the OSCs Joint Serious Offences Team (JOST) has now uncovered three RESP firms allegedly involved in this most serious of privacy breaches.
